faq's
frequently asked Questions

1. What are the New Changes to the Aged Care System?

The laws surrounding the Aged Care sector are changing. The Australian Government is updating the Aged Care Act, and the new Aged Care Act 2024 (Cth.) will come into effect from 1 November 2025. As part of this change, a new Statement of Rights will be introduced. It sets out the rights of older people when they use aged care services funded or subsidised by the Government. This new Statement of Rights will replace the current Charter of Aged Care Rights.

2. What does the Statement of Rights Means for Me?

The Statement of Rights puts you at the centre of your aged care. It helps protect your rights and make sure your voice is heard. This means you have the right to:

  • Make your own choices about your life
  • Have your decisions respected
  • Get the information and support you need to make those choices
  • Share your wishes, needs and preferences
  • Feel safe and treated with respect
  • Have your culture and identity valued
  • Stay connected to your community

3. What about the new Aged Care Code of Conduct?

In coordination with the new Statement of Rights, COHS must also comply with the Aged Care Code of Conduct. The Code outlines how aged care providers, their governing bodies (such as board members), and all workers—including volunteers—must conduct themselves and interact with people receiving aged care. It is designed to build trust and confidence in the quality and safety of aged care services. The Code:

  • Supports each person’s right to choice, dignity, and respect
  • Promotes behaviour that is kind, honest, and respectful
  • Helps protect people receiving aged care from harm

4. How will the strengthened Quality Standard affect me?

The Aged Care Quality Standards are being strengthened under the new Aged Care Act 2024 and regulatory framework. In 2021, the Royal Commission into Aged Care Quality and Safety recommended that the Department of Health,Disability and Ageing (the Department) review the Standards. As part of this review, the Commission advised that the updated Standards should cover key areas such as:

  • Food and nutrition
  • Dementia care
  • Diversity and inclusion
  • Governance
  • Clinical care

The strengthened Aged Care Quality Standards will come into effect on 1 November 2025, aligning with the introduction of the new Aged Care Act 2024. To support the sector in transitioning to these changes, we are rolling out the Stronger Standards, Better Aged Care Program. Through this program, the Aged Care Quality and Safeguards Commission will be:

  • Updating how they assess the quality of aged care and services
  • Building awareness and capability across the aged care sector
  • Streamlining their processes and resources to ensure they are clear, consistent, and easy to use

5. How do I raise a Complaint?

If you are unsatisfied with the services, you are being provided or wish to make a complaint you are well within your rights to do so.

Raising a concern is safe and straightforward. Aged care providers are not allowed to penalise anyone for making a complaint. If you feel comfortable, start by speaking directly with your service provider—this is often the fastest and simplest way to resolve the issue.

If you are dissatisfied with anything that occurs with your Support at Home services, please tell us that we can address the issue. We will use all reasonable efforts to resolve any dissatisfaction between you and COHS Pty Ltd in accordance with our internal complaints, compliments and feedback policy and procedures. If we cannot satisfactorily resolve any dispute, you may use the complaints and feedback escalation process set out in our Aged Care Participant Handbook.

6. How do I Raise a Complaint to the Commission?

You can make a complaint online, by phone or by letter. Visit the Aged Care Quality and Safety Commission website for more information.
